These Terms and Conditions define the commercial modalities between the online store WOME and the Client, service ordering, payment and delivery.
By using this website, you are automatically accepting these Terms and Conditions.
This online store is the propriety of Lucky Atom, Lda., under the social designation Wome (registered trademark), taxpayer identification number 516106414.
Luck Atom is headquartered at the following address: Praceta Fernando Pessoa, 42, 3º Esq, 2900-364 Setúbal, Portugal.
Content and Prices
Wome is committed to guaranteeing the content of this website is precise and correct when published. Despite the permanent effort in assuring content quality, mistakes or technical errors may occur and are not Wome’s responsibility. In this sense, Wome cannot guarantee the non-interruption of services due to the referred technical errors.
Wome reserves the right to suspend, alter, add or remove part of this site’s content at any moment without justification.
All prices indicated on this site are in Euro, include VAT at the statutory rate and exclude shipping costs. Any alteration in the type of applicable VAT will be reflected in product prices.
Regarding shipping costs, when the delivery method is chosen, shipping costs will be calculated based on destiny, delivery method, and total weight. Prices are subject to alterations without prior notice.
To place an order, a Client must provide:
– E-mail address
– Telephone/mobile number
A Client placing an order is equal to them fully accepting the prices and descriptions of the products available for sale and general sale conditions, which will be the only ones applicable to the contract celebrated in this way.
Wome will honour the online orders it receives up until the limit of available stock. In the case of a lack of available product, Wome will inform the Client as soon as possible. Wome further reserves the right to refuse any order.
Order delivery will be made to the address supplied by the Client during the ordering process.
Costs and delivery times will be communicated to the Client when they place an order. By confirming the order, the Client accepts those costs and delivery times.
Shipping costs accepted by the Client at the time of purchase correspond to a service supplied by Wome’s distribution partners/carriers whose only purpose is to deliver the order from point A (Wome warehouse) to point B (address indicated by the client). To track an order in transit, the Client may contact the corresponding distribution partner’s/carrier’s Customer Support Service.
Purchase invoice/receipt will be sent by e-mail.
If the Client does not claim the order delivered by the distribution service/carrier within the time designated for doing so and the order is returned to Wome, the Client will have to support new shipping costs.
Wome has various payment methods available for Clients:
– Credit card (through the Stripe platform)
– Bank transfer
For credit card payments, a debit will be executed when the purchase is confirmed.
Wome does not have access to its Clients’ payment details and is committed to guaranteeing maximum confidentiality and safety of the data transferred through the internet.
Exchanges and Returns
Any product purchased on wome.pt can be exchanged or reimbursed. The Client should contact Wome through the e-mail firstname.lastname@example.org.
The exchange or devolution should be made within a maximum of 15 days from the order shipping date.
Non-payment of an order within 48 hours of the order being placed will automatically cancel said order.
Returned products must be in the same condition/state as when delivered to the Client, without any sign of use, and in their respective packaging.
If the final value resulting from an exchange of products from an order is superior to the initial value of the order, the Client will have to defray the difference. The available payment methods may be used to execute this process. If the value is inferior, or if the case of a product return, the Client may request a refund of that value via bank transfer to an account of their choice.
Wome does not accept exchanges/returns of products that present damage to their original packaging.
Shipping and bank costs associated with product returns will be supported, totally and exclusively, by the Client. Wome reimburses the Client within a maximum period of 15 days, counting from the date the returned product is received.
Wome does not accept returns sent with paid postage or payment on delivery.
Returns will only be accepted when within the defined period. Exchanges are susceptible to stock availability. An exchange request that cannot be satisfied automatically generates a return and respective credit.
If the product is unavailable and/or out of stock, the Client will be informed of the partial or total cancellation of their order. The amount paid by the Client will be restituted in these cases.
In the case of a received product having notorious anomalies, the article should be sent to Wome for further analysis. The article may be exchanged or reimbursed if the Client returns it within 15 days, counting from the order shipping date. The Client should contact Wome at email@example.com in these cases.
The process may take 20 days. In the case of product anomaly, a new substitute product will be sent to the Client. If there is no stock of the same product, the Client may choose another product of the same value or be reimbursed with the value of the returned article. In the case of the product not presenting any anomaly, the article will be returned to the Client with payment on delivery shipping.
Wome excludes any guarantee and all responsibility for the inconveniences or losses inherent to internet use, particularly service rupture, exterior intrusion or the presence of computer viruses, or any case of force majeure so classified by court jurisprudence, up to the limit permitted by applicable law.
These Terms and Conditions constitute total agreement between parties.
In the case that one of the clauses in the present contract is declared null or void of legal standing, it will not cease to be valid in virtue of legislative or normative alterations or by a court sentence. Complying with these Terms and Conditions is always obligatory.
Wome reserves the right to alter these Terms and Conditions at any time and without prior notice.
Applicable Law and Jurisdiction
Portuguese law applies to the conditions in the present contract. In case of litigation or lack of agreement between parties, jurisdiction will be submitted to Portuguese court, regardless of the plurality of defendants and/or whatever the type of procedure.
In case of litigation, the consumer, under Law No. 144/2015, may also appeal to a Consumer Litigation Alternative Resolution Entity: National Consumer Conflict Information and Arbitration Centre (www.arbitragemdeconsumo.org).

Any changes to the Terms and Conditions of this Site will be indicated on this page and can be executed at any moment.
